Welcome to Peptra. These Terms of Service ("Terms") govern your access to and use of the website located at peptra.com, our mobile and web applications, and any related services (collectively, the "Platform"). The Platform is operated by FRQNCY LLP, a Utah limited liability partnership ("Peptra," "we," "us," or "our").
PLEASE READ THESE TERMS CAREFULLY. By creating an account, completing an intake form, purchasing products or services, or otherwise using the Platform, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Platform.
These Terms contain a binding arbitration provision and a class-action waiver in Section 18 that affect your legal rights. Please review them carefully.
1. What is Peptra and it is not
Peptra is a technology platform that connects you with independent, licensed healthcare providers and with licensed pharmacies for the evaluation, prescription (where clinically appropriate), and fulfillment of certain treatments, including peptide therapies, testosterone replacement therapy (TRT), menopause support, GLP-1 therapies, hair-loss treatments, and erectile-dysfunction treatments.
Peptra is not a medical practice, a pharmacy, or a healthcare provider. We do not practice medicine, provide medical advice, or dispense medications. All clinical decisions — including whether to issue a prescription — are made solely by the independent licensed providers, in their sole professional judgment. All medications are compounded and/or dispensed by independent licensed pharmacies, including our pharmacy partner(s).
Peptra does not guarantee that you will receive a prescription, a consultation outcome, or any particular product or result.
2. Not for Emergencies
The Platform is not for medical emergencies. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately. The Platform is not designed for urgent or emergency care, and providers on the Platform may not respond immediately to messages.
If you are having thoughts of harming yourself or others, call or text 988 (Suicide & Crisis Lifeline) or seek immediate in-person help.
3. Eligibility
To use the Platform, you must:
- Be at least **18 years of age;
- Be a resident of, and physically located in, a U.S. state or territory where our services are available;
- Have the legal capacity to enter into these Terms; and
- Provide accurate, current, and complete information about yourself.
We may add, remove, or limit availability in any jurisdiction at any time. You may not use the Platform on behalf of any other person.
4. About the Products
The products offered through the Platform are prescription products that require evaluation and authorization by a licensed provider. Certain products are compounded medications.
Important: Compounded medications are not reviewed or approved by the U.S. Food and Drug Administration (FDA) for safety, effectiveness, or manufacturing quality in the way that FDA-approved commercial drugs are. Compounded medications are prepared by licensed pharmacies for a specific patient pursuant to a valid prescription. The Platform offers generic and compounded formulations only and does not offer branded products (including, without limitation, Ozempic®, Mounjaro®, Zepbound®, or Wegovy®; all trademarks are the property of their respective owners).
Product descriptions, indications, and information on the Platform are for general informational purposes and do not constitute medical advice. Do not rely on Platform content as a substitute for professional medical advice, diagnosis, or treatment.
5. The telehealth relationship and your Consent
By using the Platform, you acknowledge and agree that:
- You are voluntarily choosing to receive services via telehealth, and you consent to be evaluated and treated remotely;
- The provider will rely on the information you supply in your intake form and any follow-up communications;
- Telehealth has inherent limitations, including that a provider cannot physically examine you, and that technology may fail or delay communications;
- A provider may determine that telehealth is not appropriate for you and may decline to prescribe, may recommend in-person care, or may discontinue treatment; and
- You may withdraw your consent to telehealth services at any time, though this will not affect services already rendered.
Where required, you will be asked to review and accept a separate Telehealth Informed Consent as part of the intake process. That consent is incorporated into these Terms by reference.
6. Accuracy of your Information
The safety and appropriateness of any treatment depends on the accuracy of the information you provide. You agree to provide truthful, accurate, and complete information in your intake forms and throughout your use of the Platform, and to promptly update your provider about changes to your health, medications, allergies, or conditions. Providing false, incomplete, or misleading information may result in an inappropriate treatment decision and may cause you serious harm. You are solely responsible for the information you provide.
7. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@peptra.com if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to safety, security, or compliance
8. Prescriptions and Fulfillments
If a provider issues a prescription, it will be transmitted to a partner pharmacy for compounding and/or dispensing and shipment. Prescriptions are valid only as authorized by the prescribing provider and applicable law. Peptra does not control, and is not responsible for, the independent clinical or dispensing decisions of providers or pharmacies. Refills, dosage changes, and discontinuation are subject to provider authorization.
9. Pricing, Payments and Subscriptions
- Prices for consultations, products, and subscriptions are displayed on the Platform and may change at any time. The price applicable to your order is the price shown at the time you place that order.
- Payment is due at the time of purchase. You authorize us and our payment processors to charge your selected payment method for all amounts due.
- Subscriptions and auto-renewal.** Certain programs are offered on a recurring subscription basis. **By enrolling in a subscription, you authorize Peptra to automatically charge your payment method on a recurring basis (e.g., monthly or per the interval shown at checkout) until you cancel.Your subscription will renew automatically at the then-current price unless you cancel before the next billing date.
- Cancellation. You may cancel a subscription at any time through your account or by contacting support@peptra.com. Cancellation stops future renewals; it does not retroactively refund charges already incurred or orders already in process. See our Refund Policy for details.
- Taxes. You are responsible for any applicable taxes.
- Failed payments. If a charge fails, we may suspend or cancel your order or subscription and may retry the charge.
10. Shipping
Shipping timelines are estimates, not guarantees. Title and risk of loss for products pass to you upon delivery to the carrier. Certain medications may require specific handling or signature on delivery. You are responsible for providing an accurate, complete shipping address and for ensuring someone is available to receive temperature-sensitive shipments.
11. Prohibited Conduct
You agree not to:
- Use the Platform for any unlawful purpose or in violation of these Terms;
- Provide false information or impersonate any person or entity;
- Resell, share, divert, or redistribute any medication or product obtained through the Platform;
- Use another person's account or allow another person to use your account;
- Attempt to obtain products for anyone other than yourself;
- Interfere with, disrupt, reverse-engineer, scrape, or attempt to gain unauthorized access to the Platform; or
- Introduce malware or otherwise compromise the security or integrity of the Platform.
12. Intellectual Property
The Platform and all content, trademarks, logos, designs, and software (excluding your personal information and content you submit) are owned by Peptra or its licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Platform for its intended personal, non-commercial purpose. You may not copy, modify, distribute, or create derivative works without our written permission.
13. Third Party Providers, Pharmacies and Services
Independent providers, pharmacies, laboratories, and other third parties are not employees or agents of Peptra. They are solely responsible for the services they render and their compliance with applicable law and professional standards. Your relationship with a provider is a direct provider–patient relationship. Peptra is not liable for the acts, omissions, or clinical judgments of any provider or pharmacy. The Platform may also contain links to or integrations with third-party services governed by their own terms.
14. Privacy
Your use of the Platform is subject to our Privacy Policy, which describes how we collect, use, and share information. Health information handled in connection with treatment may be subject to additional protections under applicable law. Please review the Privacy Policy carefully.
15. Disclaimers
THE PLATFORM AND ALL CONTENT, PRODUCTS, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Peptra does not warrant that the Platform will be uninterrupted, secure, or error-free, that any treatment will be effective, or that you will achieve any particular result. No advice or information obtained from Peptra creates any warranty not expressly stated here.
Peptra does not itself provide medical advice, and nothing on the Platform is a substitute for the professional judgment of a licensed provider.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEPTRA AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Platform, products, or services, whether based in contract, tort, strict liability, or otherwise, even if advised of the possibility of such damages.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEPTRA'S TOTAL AGGREGATE LIABILITY arising out of or relating to these Terms or the Platform will not exceed the greater of (a) the total amount you paid to Peptra in the six (6) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).
Nothing in these Terms limits liability that cannot be limited under applicable law. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
17. Indemnification
You agree to indemnify, defend, and hold harmless Peptra and its officers, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any law or the rights of any third party; or (d) any information you provided being false, inaccurate, or incomplete.
18. Dispute Resolution, Arbitration, Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
- Informal resolution first. Before filing a claim, you agree to contact us at support@peptra.com and attempt to resolve the dispute informally for at least thirty (30) days.
- Binding arbitration.Except as otherwise provided, any dispute arising out of or relating to these Terms or the Platform will be resolved by **final and binding individual arbitration administered by the American Arbitration Association (AAA) under its applicable rules, rather than in court, except that either party may bring a claim in small-claims court.
- Class-action waiver.You and Peptra agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.
- Governing law. These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules.
- Venue. To the extent any dispute is not subject to arbitration, it will be brought exclusively in the state or federal courts located in Salt Lake County, Utah, and you consent to their jurisdiction.
- Opt-out. You may opt out of arbitration by notifying us in writing at support@peptra.com within thirty (30) days of first accepting these Terms.
Note: Arbitration and class-waiver terms and their enforceability vary by state and are the subject of evolving law — confirm the specifics with counsel before publishing.
19. Change to these Terms
We may modify these Terms at any time. When we do, we will update the "Last Updated" date and, where required, provide additional notice. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
20. Termination
We may suspend or terminate your access to the Platform at any time, with or without cause or notice. Upon termination, the provisions of these Terms that by their nature should survive (including Sections 12, 15, 16, 17, and 18) will survive.
21. Miscellaneous
- Entire agreement. These Terms, together with the Privacy Policy, Refund Policy, and any consents you accept, constitute the entire agreement between you and Peptra.
- Severability. If any provision is found unenforceable, the remaining provisions remain in effect.
- No waiver. Our failure to enforce any provision is not a waiver of that provision.
- Assignment. You may not assign these Terms; we may assign them freely.
